A recent, highly restrictive interpretation by the Polish tax authority (KIS) drops a massive compliance bomb on logistics subcontractors handling intra-EU legs of international exports.

The scenario is common: Your company executes the first leg of transport (e.g., trucking cargo from Poland to a German airport) for goods ultimately destined for the UAE. Historically, businesses applied a 0% VAT rate, arguing it is a component of an international transport route, backing it up with a CMR, a global Air Waybill (AWB), and logistics tracking data. KIS has officially ruled this is illegal.

- **\[BS ALERT\]** Do not let your logistics execution teams rely on AWBs or cargo tracking systems as tax evidence. KIS explicitly stated that tracking data and route-spanning AWBs only prove the *intent* of export, not the *result*. To legally claim the 0% VAT rate, the subcontractor must possess unequivocal proof that the goods physically left the EU (e.g., the IE599 customs message).
- **\[TRENCH NOTE\]** This creates a massive structural flaw for freight forwarders. Subcontractors rarely have access to the final IE599 export document generated by the main forwarder at the edge of the EU. If your SAP TM (Transportation Management) or SD system automatically determines a 0% tax code based purely on the final destination partner in the Freight Order, you are generating massive tax risk.
- **\[HARD RECOMMENDATION\]** You must adjust your pricing procedures and condition techniques in SAP. Default these specific sub-contracted transport legs to the standard domestic VAT rate. Do not apply the 0% tax code proactively. Instead, build a process where the 0% rate is only applied via a retroactive credit memo *after* your external portal or EDI interface successfully receives and archives a copy of the IE599 customs message from the main forwarder.
